Animix — Terms of Use

Welcome to Animix. These Terms of Use ("Terms") govern your access to and use of the Animix application ("App"), including its painting, animation, and AI-assisted generation features, provided by Hosen Studio ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of terms

By using Animix, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Account, guest mode, and authentication

2.1. You may use the App's local drawing, board, video and 3D editing tools without an account ("guest mode"). To generate AI content or make purchases, you must sign in using Sign in with Apple. Work created in guest mode is stored on your device; when you first sign in, your local work and any purchases made on that device are associated with your account.

2.2. You are responsible for maintaining the security of your Apple ID credentials.

2.3. You must provide accurate information through the authentication process.

2.4. You must be at least 18 years old to create an account.

2.5. You may delete your account at any time through the App settings. Upon deletion:

• Your account information will be permanently deleted from our servers.
• Any unused credits will be forfeited.
• If you register again in the future, you will start with no credits.
• Your locally stored work, and any files kept in your personal iCloud Drive, will remain yours unless you delete them.

3. License and app usage

3.1. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

3.2. You may not:

• Modify, reverse engineer, or create derivative works of the App.
• Use the App for any illegal purpose.
• Attempt to gain unauthorized access to the App or its systems.
• License, sell, or lease any part of the App.
• Copy or distribute the App in any way not expressly permitted by these Terms.

4. AI features and content generation

4.1. The App includes AI-assisted generation features that create and modify media, including images, video clips, and 3D models.

4.2. When you generate, the specific input you choose (such as an image, a video frame, or a text prompt) is sent through our backend to third-party AI model providers, which process it to produce your requested result. These providers include the operators of the models offered in the App (for example models from Google, ByteDance, OpenAI, Kuaishou, Deemos, Tencent and others) and infrastructure providers used to route requests to them. Generated results are returned to your device; we do not permanently store your input or output media on our servers.

4.3. You retain ownership of the content you create using the App.

4.4. Your projects, boards and assets are stored as files on your device. If you enable iCloud sync, these files are stored in your own personal iCloud Drive and synced across your devices by Apple; we never receive, access, or store those files. Only the specific media you choose to generate from is transmitted for AI processing, as described in Section 4.2.

4.5. AI generation requires the use of credits, which can be purchased through the App as credit packs or obtained through a subscription plan.

4.6. We do not guarantee the uniqueness or originality of AI-generated content.

4.7. You are responsible for ensuring any content you create or modify complies with applicable laws and regulations, and that you have the rights to any images, video, or other inputs you provide.

5. User content

5.1. You retain ownership of the content you create, upload, or share through the App ("User Content").

5.2. By submitting User Content for AI processing, you grant us and our third-party AI model providers a temporary, limited license to process that content for the sole purpose of providing the AI-assisted generation you requested. We do not use your User Content to train AI models.

5.3. You represent that you have all necessary rights to your User Content and that it does not infringe on any third-party rights.

6. Privacy and data collection

6.1. Our collection and use of personal information is governed by our Privacy Policy.

6.2. We may collect usage data to improve the App and its features.

6.3. You consent to the collection and use of data as described in our Privacy Policy.

7. In-app purchases and subscriptions

7.1. The App offers in-app purchases of credits and optional auto-renewing subscription plans (Animix Pro) that provide credit allowances for AI generation.

7.2. All payments are processed through the Apple App Store and are subject to Apple's terms. Purchases and subscription entitlements are managed on our behalf by RevenueCat, our purchase- and subscription-management provider. Subscriptions are managed, and can be cancelled, in your App Store account settings.

7.3. Credits are a consumable virtual currency that is depleted when used for AI generation. New accounts receive a one-time allocation of free credits on first sign-in.

7.4. Unused credits are non-transferable and will be forfeited upon account deletion.

7.5. If a generation fails, the credits reserved for it are refunded to your balance. All monetary refunds are handled according to Apple's refund policy.

7.6. We reserve the right to modify the pricing and quantity of credits available for purchase, and the credit cost of any generation.

8. Intellectual property rights

8.1. The App, including its code, design, and features, is protected by copyright and other intellectual property rights.

8.2. All trademarks, logos, and service marks displayed in the App are our property or the property of their respective owners.

9. Disclaimer of warranties

9.1. THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

9.2. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9.3. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

10. Limitation of liability

10.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

10.2. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR CREDITS OR SUBSCRIPTIONS IN THE APP IN THE PAST 12 MONTHS.

11. Termination

11.1. We may terminate or suspend your access to the App at any time for violations of these Terms.

11.2. You may terminate your use of the App at any time by deleting your account and/or removing the App from your device.

11.3. Upon termination, sections 5, 8, 9, and 10 will survive.

12. Changes to terms

12.1. We may modify these Terms at any time by posting updated Terms in the App or on this page.

12.2. Your continued use of the App after changes constitutes acceptance of the modified Terms.
